Agenda Item Summary: As part of the Board’s continuing policy review, we recommend that it examine the proposed policy and regulatory revisions below. (Hyperlinks to the current policies and regulation are included for reference.)

Regulation DA-3: Telecommunications Use
Last reviewed in 2009, Regulation DA-3 has been updated to reflect current practice and is proposed for reclassification as Regulation GAB-R2/IIBEA-R2. As this regulation addresses telecommunications use, it is better aligned as a subsidiary regulation to Policy GAB/IIBEA: Responsible Computer System Use, which defines “computer system” as including “all ACPS-provided hardware, software, data, communications lines and computing devices, storage media, services, servers, printers, and access to the Internet and other internal and external networks.” It is currently miscategorized with the “D” policies, which address fiscal management.

Policy IGAE/IGAF: Health/Physical Education
Last reviewed in 2015, Policy IGAE/IGAF has been updated to reflect the amendment of Va. Code § 22.1-207 by HB 1604/SB 953 and by HB 1532, and the amendment of Va. Code § 22.1-253.13:1 by HB 357/SB 211 (2016; effective at the beginning of the 2018-2019 school year). In addition, it has been revised to reflect the School Board’s June 2018 expansion of recess time at the elementary level and increased “physical activity” for all students. This was made possible, in part, by the July 1, 2018 enactment of state legislation allowing school divisions to count “unstructured recreational time” (recess) for up to 15% of total required instructional time.

Policy IGAH: Family Life Education (FLE)
Last reviewed in 2016, Policy IGAH has been updated to reflect the amendment of Va. Code § 22.1-207.1:1 by HB 45 and SB101. This statutory revision requires the FLE curriculum to incorporate age-appropriate program elements addressing students’ respect for the personal privacy and boundaries of other individuals. It also requires the curriculum to incorporate age-appropriate program elements on the prevention of sexual harassment using electronic means. In addition, it allows the FLE curriculum to address programs on the law and meaning of consent, as well as programs on the prevention, recognition, and awareness of child abduction, child abuse, child sexual exploitation, and child sexual abuse.
Background: The Code of Virginia § 22.1-253.13:7 and Policy BF require the School Board to maintain and follow up-to-date policies, and that all policies shall be reviewed at least every five years and revised as needed.
Recommendation: The Superintendent recommends that the School Board review the attached revisions to Regulation DA-3, and Policies IGAE/IGAF and IGAH.
