Statutory/Regulatory Policy Revisions:
Changes to the Code of Virginia took effect in 2017 that impact School Board policies. As part of the Board’s continuing policy review, we recommend that it approve the resulting statutory and regulatory policy revisions below. (Hyperlinks to the current policies are included for reference.) Blue text reflects revisions presented to the School Board at the October 5, 2017 Board Meeting. Orange text reflects new revisions based on Board Member feedback from that meeting.
Policy BBBC: Board Member Oath of Office
Last reviewed in 2014, Policy BBBC’s policy and legal references have been updated.
Policy BBE: Unexpired Term Fulfillment
Last reviewed in 2015, Policy BBE’s legal references have been updated to reflect the amendment of Va. Code §2.2-2802 by HB 1490.
Policy BBFA: School Board Members and Employees Conflicts of Interests and Disclosure of Economic Interests
Last reviewed in 2016, Policy EFB has been updated to reflect the amendment of the State and Local Government Conflict of Interests Act by HB 1854/SB 1312.
Policy BDA: Regular School Board Meetings
Last reviewed in 2015, this policy has been updated to reflect the amendment of Va. Code § 2.2-3707 by HB 1540. Its cross references were also updated. As a result of Board Member feedback from the October 5, 2017 School Board Meeting, the word “regular” has been removed to reflect that minutes are recorded at all Board Meetings.

Last reviewed in 2015, this policy has been updated to reflect the amendment of Va. Code §22.1-3708 by HB 1540.
Policy BDC: Closed Meetings
Last reviewed in 2016, this policy has been revised to reflect the amendment of Va. Code §2.2-3711 by HB 1540.
Policy BDCA: Calling and Certification of Closed Meetings
Last reviewed in 2014, Policy BDCA has been updated to reflect the amendment of Va. Code §2.2-3712 by HB 1540.
Policy BDD: Electronic Participation in Meetings from Remote Locations
Last reviewed in 2016, this policy has been updated to reflect the amendment of Va. Code §2.2-3708.1 by HB 1540.
Policy BDDA: Notification of School Board Meetings
Last reviewed in 2014, Policy BDDA has been updated to reflect the amendment of Va. Code §2.2-3707 by HB 1540.
Policy BDDC: Agenda Preparation and Dissemination
Last reviewed in 2014, this policy has been updated to reflect the amendment of Va. Code §2.2-3707 by HB 1540. As the Code requires notice of meetings to be posted as least three working days prior to the meeting, this policy has been also revised to require the proposed agenda for regular meetings to be posted on the ACPS website at least three working days prior to the scheduled meeting.
Policy BDDG: Minutes
Last reviewed in 2015, this policy has been updated to reflect the amendment of Va. Code §2.2-3704 by HB 1539. It has also been updated to avoid duplication of matters covered in Policy KBA: Requests for Information, and its legal references have been updated.
Policy BHD: School Board Member Compensation and Benefits
Last reviewed in 2009, this policy has been updated to reflect that School Board members may participate in the Division’s group insurance plan in accordance with Policy BHE: School Board Member Liability Insurance. As a result of Board Member feedback from the October 5, 2017 School Board Meeting, references to Alexandria City Charter provisions discussing Councilmember compensation and election cycle timing have been added.

Background:

The Code of Virginia § 22.1-253.13:7 requires that each local school board shall maintain and follow up-to-date policies, and that all policies shall be reviewed at least every five years and revised as needed. In addition, the Alexandria City School Board’s Policy BF provides that policies will be reviewed at least every three years and revised as needed.
